Ce qui met fin au suspense sur la possible candidature du pr\u00e9sident de la Transition \u00e0 la magistrature supr\u00eame dans sept mois.<\/strong><\/p>\n\n\n\n<p>La question \u00e9tait sur toutes les l\u00e8vres depuis la tenue du dialogue inclusif d\u2019avril 2024. Les recommandations issues de cette grand-messe laissaient d\u00e9j\u00e0 pr\u00e9sager, \u00e0 la fin de la Constituante, de la possibilit\u00e9 de certains acteurs de la transition actuelle de se pr\u00e9senter \u00e0 la pr\u00e9sidentielle. Depuis le 20 janvier 2025, l\u2019\u00e9pais myst\u00e8re qui enveloppait la question de la candidature des membres du Comit\u00e9 pour la transition et la restauration des institutions (CTRI) \u00e0 l\u2019\u00e9lection pr\u00e9sidentielle, vient d\u2019\u00eatre lev\u00e9.<\/p>\n\n\n\n<p>De fait, les Parlementaires ont adopt\u00e9 la mouture du code \u00e9lectoral issue des assises d\u2019avril 2024. Le texte, dans ses dispositions, permet aux militaires et aux magistrats de faire de candidater \u00e0 l\u2019\u00e9lection pr\u00e9sidentielle. Seul b\u00e9mol, cette disposition prend le contrepied de l\u2019article 25 de la Charte sur la d\u00e9mocratie, les \u00e9lections et la gouvernance de l\u2019Union Africaine. Celui-ci fait interdiction \u00e0 toute autorit\u00e9 issue d\u2019un coup d\u2019\u00c9tat de \u00ab participer aux \u00e9lections organis\u00e9es pour la restitution de l\u2019ordre d\u00e9mocratique, d&#8217;occuper des postes de responsabilit\u00e9 dans les institutions politiques de leur \u00c9tat \u00bb.<\/p>\n\n\n\n<p>Dans l\u2019optique de contourner ce pi\u00e8ge, le pays \u00e9tant sous le coup d\u2019une suspension des instances de l\u2019organisation panafricaine depuis ao\u00fbt 2023, le nouveau code \u00e9lectoral dispose que les militaires et magistrats d\u00e9sireux de faire acte de candidature doivent au pr\u00e9alable prendre une mise en disponibilit\u00e9 avant cette \u00e9ch\u00e9ance.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le texte du nouveau code \u00e9lectoral adopt\u00e9 dans la nuit du 20 au 21 janvier 2025 offre la possibilit\u00e9 aux magistrats et aux militaires de briguer les suffrages des \u00e9lecteurs.
